试论赔偿性惩罚制度在我国的适用
摘    要
 惩罚性赔偿作为英美法系国家的一项重要民事法律制度,经历了几百年的发展历史。随着时代的发展和法律理念的进步,以及大陆法系和英美法系的不断融合,惩罚性赔偿日益受到人们的关注,它也成为我国民事立法和民法理论中的一个新课题。通过了解惩罚性赔偿在我国侵权法中适用的现实依据及条件，我们能进一步掌握惩罚性赔偿制度在我国的适用要件、适用范围以及适用现状;才能进一步提出完善我国惩罚性赔偿制度的构想。惩罚性赔偿在侵权行为法领域的建立,是侵权行为法本身各种功能相互碰撞和协调发展的产物,也是历史的选择，因此，在我国侵权法中设立并完善惩罚性赔偿制度非常具有合理性和必要性。

Abstract
 Punitive damages are a significant type of damages in the states of Anglo-American law system with a history of more than 200 years. With the development of times and legal theory, the law systems of the continent and Anglo-American become more bridgeable. Punitive damages attract more interest world-widely. It is now much controversial and disputed in china. By understanding the punitive damages in our tort law and conditions applicable to the practical basis, we can further understand the system of punitive damages, the applicable elements in our country, the scope and application of the status; in order to further improve China put forward the idea of ​​punitive damages system. The development of Tort Law can prove that Punitive Damages System is the requirement of deterrent function of Tort Law. It not only the development of tort law, but also the historical choice.
