摘  要

    随着世界经济的不断发展和国际贸易的日益频繁，信用证已经成为国际贸易结算中重要的信用支付工具。无论是在发达国家还是发展中国家，国际贸易结算采取信用证的方式都占了相当大的比例。改革开放以来，随着我国经济的飞速发展，我国的对外贸易也不断扩大，与之相对应的就是信用证结算在我国国际贸易中所占的比重越来越大，近年来进出口贸易采用信用证结算方式比重占到50％以上。可是由于信用证其自身相对独立性的特点和国际上信用证相关法律法规的不健全，信用证诈骗的案件也频频发生。且由于信用证诈骗所涉及的金额往往较大，在发展中国家发生比例又很高，这就严重危害了国际贸易的正常进行，破坏了正常的国际金融秩序，也严重打击了信用证给予买卖双方的信心，由此可见其危害之大。
 本文拟通过对信用证诈骗的常见方式、特征和相关案例的阐述，以及对信用证诈骗产生原因的分析，并且针对这些问题提出相应的防范措施和对策，以期对外贸公司在对外贸易结算过程中使用信用证支付的条件下规避风险，防止不必要的损失以及达到快速，安全收汇有所帮助。

Fraud in Letter of Credit and its Preventive Measures
 

ABSTRACT：
 Along with the world economics boom and high technology development ,letter of credit has became a major means of payment in the international trade .But by exploiting the characteristics of the transaction with L/C ,some outlaws colluded together and fiercely committed cheating behaviors in all the operative parts of L/C ,which cause a lot of economic loss to the persons who are entitled to the rights of L/C, and also brought damage to the bank’s credit ,destroyed the order of the transaction. Base on the analysis to the letter of credit cheating way and reasons, this article proposes corresponding presentation measure.
