中文摘要

    作为现代经济的核心，银行业的安全和稳健是一国经济稳定和发展的重要保障，银行监管对于实现金融体系的安全与稳定，保护存款人的合法权益以及促进银行公平有效地竞争，提高银行业效率，维持经济的可持续稳定地增长有着重要作用。
 本文研究的是从法律角度分析在金融全球化的背景下，我国银行业监管机构面对金融开放及金融危机的大潮中监管对银行的影响及作用，从而应如何完善银行监管，将经济全球化中出现的问题带给中国银行业的冲击尽可能降到最低，并借助这个契机大力提升我国本土银行业的国际竞争力。文章首先对我国银行监管的必要性进行分析，从而深刻剖析目前我国银行业监督管理法律制度上存在的主要缺陷和不足；然后通过对比借鉴发达国家在银行业监管方面的先进经验并充分考虑我国目前的具体情况，提出对我国银行业监管法律体系进行完善和创新的基本措施，并在对我国银行业外部监管法律制度的完善、构建我国银行业及其同业自律法律制度、完善银业监管机构管理机制等方面提出具体建议和构想。
 随着国际经济的繁荣发展，近几年的金融危机濒繁地出现，各国着重从作为金融核心的银行业进行金融危机地防范，开始加重地对银行业的监管规制。要跟上国际化的发展，有必要结合我国的国情，对银行监管进行法律研究，加快完善我国银行监管的法律法规建设，使之能与国际的监管标准相协调。

 As the modern economy's core, banking industry's security and steady is a country economy stability and advancement important safeguard, the banking supervision regarding realizes financial system's security and stable, protects depositor's legitimate rights and interests as well as promotes the bank to compete effectively fairly, raises the banking industry efficiency, the maintenance economy grows stably sustainably has the influential role.
 What this article studies is from the legal angle analysis under the financial globalization background, Our　country Banking industry supervision organization supervises facing the financial opening and in financial crisis's flood tide to the bank the influence and the function, thus how should the perfect banking supervision, appear the economic globalization in the question takes to China Banking industry's impact on fall as far as possible to lowly, and draws support from this turning point to promote our country Native place Banking industry's international competitiveness vigorously.The article first carries on the analysis to Our country banking supervision's necessity, thus analyzes the main flaw which and the insufficiency profoundly in the present Our country Banking industry management by supervision legal regime exists; Then profits from the developed country through the contrast in the banking industry supervision aspect advanced experience and considered fully our country present special details, proposed carries on the consummation and the innovation basic measure to Our country Banking industry supervision legal framework, and to Our country Banking industry exterior supervision legal regime's consummation, constructs Our country Banking industry and the same business autonomy legal regime, aspects and so on perfect silver industry supervision organization management mechanism proposes the concrete proposal and the conception.
