摘  要

 黑社会是在国家政治、社会体制以及人民意志作用下的负面产物，也是世界上大多数国家亟待解决的问题。由于社会体系的紊乱，黑社会结构的复杂，要想从根本上铲除黑社会，成为一场漫长而持久的拉锯战。
 目前，中国并没有真正意义上的黑社会体系，但是却存在黑社会的雏形，即黑社会性质组织。这样的社会毒瘤正日益影响着中国社会主义的前进步伐，也影响着人民生活的安定和谐。随着我国社会主义法治的逐步完善，黑社会性质组织不会发展成真正意义上的黑社会，更不能从政治、经济等方面影响国家的命脉，这就为我国解决黑社会性质犯罪奠定了坚实的基础。
 虽然我国现行刑法已经存在相关问题的立法，但是由于法律的稳定性，近十几年来，关于黑社会性质组织的犯罪的规定本质上并没有发生改变，在惩治黑社会性质犯罪上显得力不从心。司法实践当中，也体现出我国在此方面的立法瑕疵。因此，健全黑社会性质犯罪立法已成为当前完善立法的一项迫切任务。

Research on the Crime of Mafia-style Organization
Abstract
 
 Mafia-style Organization is negative outcome of nation politics, social system and peoples’ will, and also is the public concern in the most countries around the world. For the disorder of social system and complex of the Mafia-system, there is still a long time battle in this matter if the Mafia organization is eradicated from its root.
 Recently, there is no Mafia Organization in juristic meaning. However, the embryonic form of Mafia Organization-----Mafia-Style Origination still exists in China. The Black Sheep is hindering the progressive paces of our society and the harmony and stability of people’s life increasingly.
 As the perfecting of socialist rule by law, the Mafia-style Organization couldn’t turn into Mafia Organization in juristic meaning and influence the politics and economy of country’s lifeline, which lays solid foundation for preventing the crime of mafia-style organization.
 Even though china had legislated referring to the mafia-style organization in crime, for recently decades, the essence of regulations on this crime had never changed and punishment of the crime of mafia-style organization had never satisfied the purpose of the law.
Furthermore, the flaw of legislation related to mafia-style organization is also reflecting in judicial practice. So, it is an urgent task of perfection legislation to strengthen the legislation on the crime of mafia-style organization
